Unless you want the tenants to stay, the answer would be “No.” Either way, make sure it is specifically stated it the contract.

As of the pre-closing walk through, you should see the home as you will be receiving it. Either with or without the tenants. If without, the place is supposed to be empty and broom swept.

We made an offer on a house about 3 months ago (southern california/riverside county).. It is a preforclosure/short sale and the list price is 419,000. We offered 375,000. The real estate agent said that is would take 6-8 weeks possibly, but it has now been over 3 months of waiting and we are getting pretty impatient.

Every time we call the real estate agent he says there is “no news.” We would like to speak with the mortgage company for the seller as they are reportedly the ones holding up the process, but the real estate agent will not give us their contact info. Is this normal?

What should we do at this point? I have considered giving like a 5 day take-it-or-leave-it ultimatum to see if that “inspires” some type of action. There are no other offers on this house that we are aware of and it has been on the market for about 7 or 8 months.

Please advise!
Yes, a time limit was put on the offer, which has now expired. We do want this house, so if a higher offer is needed then what type of percentage would get the go ahead below the asking price… The cost isn’t really an issue, but we would like to get the best deal possible of course!

Whether or not you obtain the contact name of the mortgage holder, they’re not going to speak with you about this situation. When you engage in short sale offers, this response time often occurs. The lender is most probably not thrilled with your offer, and is biding time to see if a better one comes along.

Sending an ultimatum will be ignored. I’d recommend that you withdraw your offer and start looking elsewhere.

Can they state that they are a “real estate agent”?

If I wanted to sell my home fast in a slow market, I would focus on 3 main things: highly targeted advertising, perfect presentation, and creating a sense of urgency. In fact, it’s basically the same as a booming market, only I’d tweak my ads a lot. This article goes over these 3 major points in order to help you sell your house in the current tough financial times.

Highly Targeted Advertising

The past decade has generally been quite easy for people selling homes. That is of course until the recent market crash. Whilst the traffic is generally still high, much less of this traffic would fall into the “serious prospect” category. To avoid the window shoppers, you need to launch a laser targeted marketing campaign.

So, how can you do this? Firstly you need to present a competitive price. The people who are actually buying property at the moment are generally investors rather than families. They’re after a solid price, and let’s face it, they have the advantage. Get your home valued by a third-party, pick a good price, stick to it!

As for the actual sales copy. You want to call out to people with phrases like “below market value” (even if it’s not) and “move in today”. These phrases show that you mean action.

Presentation Perfect

You absolutely must get your property looking sexy for show. I’m not talking about merely cleaning the place up and fixing the front gate. In fact, hiring a bunch of upmarket furniture goes a long way in getting good, quick offers from prospective buyers.

Make sure to boost your “curb appeal” by making the exterior of the house look good too. This might mean a new paint job, planting some trees, or just a couple of wind chimes.

Creating A Sense of Urgency

This one is the most important if you want to sell within a month. The aim is to get your buyers excited and perhaps a bit nervous so they make quick, high offers without hesitation. This can be achieved easily by holding a mass event showing, with all of your prospects in the house at the same time. They will be able to mingle with each other, and they will really feel the competition.
