Question by David: Can I claim my 2010 property taxes on my tax return, if they were paid by escrow?
For the past 1.5yrs, I have been slipping towards a foreclosure. It still hasn’t happened yet. I haven’t made a payment in 15mo. And they haven’t even sent me a warning yet. Back in summer 09 I tried a loan modification. One of the Fed requirements is they open up an escrow to pay the property taxes so they keep their interest in the property. So they paid my Winter 09 taxes and Summer 10 taxes. Now in between those two payments, I stopped paying my mortgage. No more escrow payments either. They figured that I wasn’t paying and sent me a letter saying “we’ve opted to remove your escrow from your account and you “I” will be responsible for paying it from now on.
Ok, now the legal question. Those summer property taxes were paid in 2010 by the mortgage company. Technically my name is on the mortgage note, on property, and not in foreclosure “YET”. On receipt, it shows I paid it. Can I legally claim that on my 2010 tax return? Does the IRS have any special interest in who technically pays it, even though my name is on it?

your name was on the mortgage, but you did not pay them. therefore, you cannot claim them. if foreclosure occurs, the irs will be interested as well as lawyers and the bank on who paid taxes. it took less time for bank to foreclose on my house. talk to bank who has your mortgage and find out your options. once you get foreclosure letter, your out of options

Do you have a property that you want to sell? You can sell it through sales agent or through private house sales. Both of these will definitely give you enough exposure to get clients buying your property. However, you need to know all the pros and cons so it will guide you what options to take.
For sales of property through sales agents you will have the following pros and cons:
Pros:
Sales agents require considerable amount of commission compared to private house sales. This is because sales agents or brokers are usually licensed to qualify as property brokers. This means that they have gone all the way to become professional agents sell properties and they have such level of expertise.
Compared to for sale by owner, sales agent has lot of networks and connection, which will expose your property.
Sales agents are hardworking individual because their aim is to sell your property.
Cons:
Sales agents have high commission. For an individual who wants to sell property, it would mean setting aside high percentage from the selling price of the property.
The owner can do what the agent can do to sell the property. It just needs enough exposure of the property for sale by owner.
Sales agents may not know much about the property that you are too familiar with. After all, it is your property.
Sales agents may not be there when the buyer will have complains about the property sold. Sales agents are good as selling the property only. Some unethical sales agents would even give sales pitches that are not real. When the deal is closed and there seemed to be a promise of the agent that is not fulfilled, it is possible that the buyer will run to the owner of the property to express the complaints.
If you think having sales agent will not work for you, then you need to have private house sales. This is good as for sale by owner, without intervention of sales agents. Here are the pros and cons of properties for sales by owner.
Pros:
The owner will have full control of the private house sales. The owners can make ways to expose the sales on their own and it will be their discretion to stop the sale. In other words, they will not be bounded by any contract.
For sales by owners will save considerable amount of money from commission. The owner will not be obliged to impart a percentage of the selling price for commission of a middleman.
The owner will have control on the information given to the buyer. It s possible that the owner will not give too much sales pitch just to sell the property.
Cons:
The owner will have no enough networks of buyers.
The owner may not have enough time to advertise the sale.
The owner may not have enough expertise in dealing with property sale or private house sales.
When you find that it is more beneficial for you to sell privately rather than through sales agent, you just need enough exposure for the sale. This means utilizing the Internet and other medium for advertisement. There may even be guides from the advertisers of private house sales that you can get to know how to sell your property well.

Yes, it is possible to sell your home fast, even in these troubled times when buyers are scarce. A quick sale option may be ideal for anyone who does not have the luxury of being able to put their property on the market and wait for interest and who wishes to avoid the large fees of estate agents and solicitors. Many people try to determine the values of their real estate by researching websites that value a home based on aggregate data collected through various means. While these online services can be quick and seem easy, computer generated reports can be grossly inaccurate. More often than not, computer data collected from outdated and often unreliable resources can cause issues when trying to determine a fair value of real estate in any specific market. These websites may be of some value in showing valuation trends, but can in no way replace the services of a local real estate appraiser. Real Estate Broker Price Opinion
Highly trained professional real estate appraisers, while more expensive, can effectively determine a home’s true value and also take into account variables a computer generated report can’t. Desirable factors such as a highly rated school system, economic development and surrounding neighborhoods can drastically affect a home’s value positively. Areas that are run down but in the midst of a gentrification process are unlikely to get a fair appraisal from a computer model, someone untrained or out of the area. Only a local appraiser will be familiar with rising or declining valuations and building trends in specified locations.
While obtaining a professional real estate appraiser to correctly determine a home’s value can be critical during a divorce, to value an estate, or to satisfy a lender requirement for a mortgage, choosing a reputable local appraiser that knows their market area can mean the difference between a good appraisal and a bad one. If an appraiser does not intimately know the market area they serve, many factors used to determine a home’s value can be left out of the process. Without knowledge of the current market area trends, property values given by an appraiser outside of their locale can be skewed.
As banks and other financial institutions are now dealing with untenable volumes of foreclosed homes, there is a growing trend among banks and other financial institutions to hire real estate brokers to complete BPOs (Broker Price Opinion), rather than pay appraisers for a home’s valuation. Although BPOs should be more accurate than computer generated reports in determining a property’s value, there is considerable controversy as to whether or not these real estate agents have adequate training to complete these reports effectively. BPO services cost less than a uniform appraisal report; however, much like their computer generated counterparts, BPOs often omit crucial information. Many lenders do not even require an in-depth inspection or interior inspection of a home, for example. How can anyone hope for any type of realistic property valuation without an on-site inspection?
Appraisers are required to complete a stringent course of training through accredited educational facilities before they are licensed or certified. In some states, appraisers must also complete an apprenticeship under a more seasoned professional prior to being permitted to value property independently. A good appraiser will look at all aspects of the property, including square footage, room count, types of rooms, condition of property, lot size, neighborhood trends and comparable properties in the area that have sold recently, as well as comparable properties currently on the market.
Appraisals take longer than a BPO provided by a real estate broker or online computer generated reports. But, the report from appraisers is in depth and lengthy. All variables used to arrive at the valuation are in black and white.
Searching for a qualified appraiser in your area is relatively easy. Neighborhood banks and lenders are a great referral source. Searching an online directory or your local yellow pages can be another viable source as well when looking for a professional appraiser. Real Estate Broker Price Opinion
